These Terms and Conditions ("Terms") govern your use of the services provided by Blue Akoya Design ("we," "us," or "our"). By engaging our services, you agree to be bound by these Terms. Please read them carefully before placing an order or using our website.
Blue Akoya Design offers brand identity design, website design, digital business cards, marketing materials, and social media packages. The specific deliverables, timelines, and pricing for each project will be outlined in a separate project proposal or invoice provided before work begins.
Upon acceptance of a proposal and receipt of payment, we will begin work according to the agreed timeline. Timelines are estimates and may vary depending on the complexity of the project and the timeliness of client feedback. Delays caused by late client responses or incomplete information may extend the delivery date.
All prices are listed in USD unless otherwise stated. A 50% non-refundable deposit is required to hold your project date and secure your spot in our schedule. The remaining 50% balance is due before final deliverables are released. We accept payments via the methods specified on our invoices. Late payments may result in project delays or suspension of services.
All website design projects require the use of Blue Akoya Design's hosting services at $50 per month. This hosting fee is separate from the one-time website design fee and is billed monthly. The hosting service includes reliable server hosting, regular backups, security updates, and technical support. Clients must maintain an active hosting subscription to keep their website online. Failure to pay monthly hosting fees may result in website suspension or termination. Hosting fees are non-refundable and must be paid in advance on a monthly basis.
Each service package includes a specific number of revision rounds as outlined in the project proposal. Additional revisions beyond the included rounds will be billed at our standard hourly rate or a per-item fee. Revision requests must be submitted in writing within 7 days of receiving deliverables.
Upon full payment, you receive a license to use the final deliverables for the purposes outlined in your project agreement. Blue Akoya Design retains the right to display completed work in our portfolio, website, and marketing materials unless otherwise agreed in writing. Source files and working files remain the property of Blue Akoya Design unless a separate transfer agreement is made.
You are responsible for providing accurate and complete information, brand assets, content, and feedback in a timely manner. You confirm that any materials you provide (logos, images, text) are owned by you or that you have the rights to use them. Blue Akoya Design is not liable for any intellectual property disputes arising from client-provided materials.
If you wish to cancel a project, please notify us in writing as soon as possible. Cancellations made before work has begun may be eligible for a full refund. Once work has commenced, refunds will be prorated based on the amount of work completed. Completed deliverables that have been delivered are non-refundable.
Blue Akoya Design shall not be held liable for any indirect, incidental, or consequential damages arising from the use of our services or deliverables. Our total liability shall not exceed the amount paid by you for the specific project in question. We are not responsible for any loss of revenue, data, or business opportunities resulting from the use of our designs.
We respect your privacy and will treat all project-related information as confidential. We will not share your business information, strategies, or proprietary content with third parties without your written consent, except as required by law.
Our services may involve the use of third-party tools, platforms, or services (such as website hosting, fonts, or stock imagery). We are not responsible for the terms, availability, or performance of any third-party services. Any additional costs for third-party tools or licenses are the responsibility of the client unless otherwise agreed.
We reserve the right to update or modify these Terms at any time. Changes will be posted on our website and will take effect immediately upon posting. Your continued use of our services after any changes constitutes acceptance of the updated Terms.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Blue Akoya Design operates. Any disputes arising from these Terms shall be resolved through good-faith negotiation, and if necessary, through binding arbitration.
